1. General information

These General Terms and Conditions of Sale regulate the purchase of products made through the website www.puntodecruzyarte.com.

By placing an order in our online store, the customer declares to have read and accepted these conditions, as well as the other policies published on the website: Legal Notice, Privacy Policy, Cookies Policy, Shipping and Delivery, Changes and Returns, Cancellation Policy, and Made-to-Order Products.

5. Product availability

Product availability may vary due to actual stock, simultaneous sales, technical errors, supplier restocking, or logistical incidents.

If a purchased product is ultimately unavailable, Punto y Arte will contact the customer to offer a suitable solution, which may consist of:

  • waiting for a restock;

  • replacing the product with a similar one;

  • modifying the order;

  • issuing a coupon or credit, if the customer accepts;

  • processing a refund for the unavailable product.

Punto y Arte will not be obliged to supply a product that is no longer available, discontinued, or cannot reasonably be obtained from the supplier.

6. Made-to-order products

Some products may be marked as made-to-order.

A made-to-order product is not necessarily available for immediate shipment from our warehouse. It may be specially requested from the supplier, distributor, or manufacturer after receiving the customer's order.

Made-to-order products may require additional processing, reception, and subsequent shipping time.

The timeframe may vary depending on the brand, supplier, country of origin, transport, holidays, customs, or external circumstances.

If the customer places an order containing both in-stock and made-to-order products, the order may be shipped when all products are available, unless otherwise agreed with the customer.

7. Prices

The prices published on the website are expressed in euros and include applicable taxes, unless otherwise expressly stated.

Shipping costs are not always included in the product price. They will be calculated and displayed during the purchase process before finalizing the order, depending on the destination, weight, volume, order amount, and available shipping method.

Prices, discounts, promotions, and commercial conditions may change at any time. Changes will not affect already confirmed orders, except for obvious errors, technical incidents, or justified circumstances.

8. Promotions, discounts, and coupons

Punto y Arte may offer promotions, discounts, coupon codes, temporary offers, or special conditions.

Promotions will be subject to the conditions indicated on the website, in the commercial communication, or on the coupon itself.

Unless expressly stated otherwise, discounts are not cumulative.

9. Errors in prices, stock, or information

If we detect an obvious error in an already placed order, we will contact the customer to inform them of the situation and offer a suitable solution.

Punto y Arte may cancel or modify orders affected by obvious errors, lack of availability, technical incidents, abusive use of discounts, or any other circumstance preventing the correct processing of the order.

In case of cancellation due to error or unavailability, the corresponding amount will be refunded to the customer.

10. Purchase process

To place an order, the customer must select the products, add them to the cart, provide the requested data, choose the available shipping method, and make the payment.

Before confirming the purchase, the customer must carefully review:

  • selected products;

  • quantities;

  • price;

  • shipping costs;

  • delivery address;

  • contact details;

  • payment method;

  • conditions applicable to the order.

Once the order is placed, the customer will receive a confirmation email.

The automatic order confirmation proves that we have received the purchase request, but it does not prevent Punto y Arte from contacting the customer if there is a stock, price, payment, address, availability, or any other issue that prevents the order from being processed correctly.

To make a purchase at Punto y Arte, the customer must have sufficient legal capacity to enter into a contract.

If the buyer is a minor, they must have authorization from their parents, guardians, or legal representatives.

The customer is responsible for providing correct, complete, and updated information for order management, payment, invoicing, and delivery.

This includes, among others:

  • complete address;

  • postal code;

  • city and province;

  • country;

  • phone number;

  • email address;

  • billing details, if applicable.

Punto y Arte is not responsible for delays, failed deliveries, returns, or additional costs resulting from incorrect, incomplete, or outdated data provided by the customer.

13. Payment methods

The customer can pay using the methods available on the payment screen of our online store.

These methods may include bank card, PayPal, bank transfer, or other systems enabled at any given time.

Payments are processed through secure payment platforms. Punto y Arte does not store full customer bank card details.

If payment is not processed correctly, the order will not be considered confirmed and will not be prepared or shipped.

14. Order confirmation

Once payment has been successfully made, the customer will receive an order confirmation in the email indicated during the purchase.

The customer must review this confirmation and contact Punto y Arte as soon as possible if they detect any error in products, address, personal data, or billing.

If the order has already been prepared, shipped, or processed, changes may not be possible.

15. Order preparation

Orders with products available in stock are normally prepared within 24 to 72 business hours from payment confirmation.

Orders placed on Saturday, Sunday, or a holiday will normally begin to be processed on the next business day.

This period may vary depending on order volume, promotional campaigns, holidays, product availability, stock review, or circumstances beyond Punto y Arte's control.

Order preparation is not equivalent to transit time. The total delivery time may include preparation time plus shipping time.

16. Shipping and delivery

Orders are shipped according to the Shipping and Delivery Policy published on our website.

Delivery times are estimated and may vary depending on destination, transport company, order volume, holidays, logistical incidents, customs, or other external causes.

The customer will receive a tracking number, when available, to check the shipping status.

The customer is responsible for reviewing the tracking, attending to notices from the transport company, and collecting the package within the indicated timeframe if it is available at an office, collection point, or depot.

17. Shipping costs

Shipping costs are calculated automatically before completing the purchase.

The amount may vary depending on the destination, weight, volume, total order amount, and available shipping method.

The customer can see the shipping costs before confirming and paying for the order.

If free shipping is offered, it will only apply under the conditions indicated on the website or during the purchase process.

18. Incorrect address, absence, or uncollected package

The customer is responsible for correctly indicating the delivery address and for monitoring the order tracking.

If the order is returned due to an incorrect address, incomplete data, repeated absence, delivery refusal, uncollected package, or a cause not attributable to Punto y Arte, once the package has been received back and its condition checked, we may process the corresponding refund.

In these cases, shipping, return, and other transport costs incurred may be deducted from the refund, in accordance with applicable regulations.

If the customer wishes to receive the order again, they must pay the corresponding new shipping costs.

Failure to collect the package or refusal of delivery will not automatically be considered a valid cancellation of the order or a formal communication of withdrawal.

19. International orders, customs, and taxes

Orders shipped outside of Spain may be subject to longer delivery times.

For shipments outside the European Union, the order may be subject to customs procedures, taxes, duties, or other import charges required by the destination country.

Unless expressly stated otherwise, these costs are not included in the product price or in the shipping costs paid in our store, and will be the responsibility of the customer.

Punto y Arte is not responsible for delays caused by customs, border controls, administrative retentions, or procedures specific to the destination country.

If the customer refuses delivery due to not wanting to pay taxes, duties, or import charges required by the destination country, shipping, return, and other costs incurred may be deducted from the refund, in accordance with applicable regulations.

20. Order cancellation

The customer can request the cancellation of an order provided that it has not yet been prepared, packed, shipped, specially ordered from the supplier, or processed in such a way that costs have already been incurred.

To request a cancellation, the customer must contact Punto y Arte as soon as possible, indicating the order number and the email address used in the purchase.

If the order has already been prepared, shipped, or processed, cancellation may not be possible.

In that case, the customer may exercise, if applicable, their right of withdrawal once the order has been received, in accordance with the Changes and Returns Policy.

21. Right of withdrawal

As a general rule, consumer customers have a period of 14 calendar days from the receipt of the product to exercise their right of withdrawal, except for legally established exceptions.

To exercise this right, the customer must clearly communicate their decision within the corresponding legal period.

Simply failing to collect the package, refusing delivery, or automatic return by the carrier will not, by itself, be considered a valid communication of withdrawal, unless the customer has expressly communicated their decision within the legal period.

In case of withdrawal, the direct costs of return will be borne by the customer, unless Punto y Arte has agreed to assume them or the return is due to an error attributable to our company.

The customer must return the product complete, unused, in good condition, and with all its original components.

22. Changes and returns

Changes and returns will be managed in accordance with our Changes and Returns Policy.

To accept a return, the product must be returned complete, unused, in good condition, and with all its original components.

In the case of cross-stitch kits, the product must include all its original elements: chart, instructions, threads, fabric, needle, packaging, and any other component included.

If the product has been used, handled more than necessary, is incomplete, damaged, opened in a way that loses commercial value, or cannot be resold as a new product, we may apply a proportional reduction of the amount to be refunded for the loss of value of the product, in accordance with applicable regulations.

23. Damaged, defective, or incorrect products

If the customer receives a damaged, defective, or different product than ordered, they must contact Punto y Arte as soon as possible.

To properly review the incident, the customer may be asked for clear information and photographs of the product, packaging, shipping label, and received content.

When the incident is attributable to Punto y Arte, the manufacturer, or shipping, we will offer a suitable solution depending on the case: replacement, sending missing parts, repair, partial refund, full refund, or another solution agreed with the customer.

24. Legal guarantee

All products sold at Punto y Arte have the corresponding legal guarantee in accordance with applicable regulations.

The guarantee covers manufacturing defects or lack of conformity existing in accordance with current legislation.

The guarantee does not cover damage caused by incorrect use, improper handling, normal wear and tear, loss of components, accidental damage, inadequate storage, or alterations made by the customer.

For embroidery, cross-stitch, and craft products, the guarantee does not cover errors derived from incorrect chart reading, inappropriate use of materials, thread substitution, modifications made by the customer, or handling not in accordance with the normal use of the product.

25. Cross-stitch kits and included materials

Cross-stitch kits include specific materials prepared for each design.

The content may vary depending on the brand or manufacturer, but normally may include a chart, instructions, fabric, threads, needle, and other accessories indicated in the product description.

The customer must check the kit content before starting the work.

If a lack of material, error, or incident is detected, the customer must contact Punto y Arte as soon as possible, providing photographs and sufficient information to review the case.

Punto y Arte may offer a suitable solution, such as sending missing material, replacement, technical clarification, or other reasonable solution depending on the case.

26. Digital products

Digital products, downloadable patterns, PDF files, embroidery application files, or other digital content may be excluded from the right of withdrawal once access, download, or digital delivery of the content has begun, provided that the customer has expressly accepted the loss of the right of withdrawal in accordance with applicable regulations.

The customer is responsible for verifying that their device, application, or program is compatible with the digital file before making the purchase or download, unless the product description indicates otherwise.

Unauthorized copying, distribution, sale, publication, resale, assignment, or commercial use of digital files, patterns, charts, or diagrams is not permitted.

27. Intellectual Property

All content on the website, including texts, photographs, images, designs, logos, graphics, trade names, page structure, descriptions, visual material, and other elements, are the property of Punto y Arte, their respective owners, or are used with authorization.

The purchase of a product does not grant the customer reproduction, distribution, modification, or commercial exploitation rights over designs, graphics, patterns, charts, photographs, brands, or protected materials.

The kits, graphics, patterns, charts, and designs included in the products may be protected by copyright. Their use is limited to the personal use permitted by the purchase of the product, unless expressly authorized by the rights holder.

32. Force Majeure

Punto y Arte shall not be liable for delays or non-performance caused by circumstances beyond its reasonable control, including logistical incidents, strikes, transportation restrictions, customs problems, natural disasters, supply interruptions, technical failures, regulatory changes, conflicts, pandemics, or other force majeure situations.

33. Modification of Conditions

Punto y Arte reserves the right to modify these General Terms and Conditions of Sale at any time to adapt them to legal, technical, commercial, or website operational changes.

The applicable version will be the one published on the website at the time of purchase, unless applicable regulations provide otherwise.

34. Applicable Law and Jurisdiction

These General Terms and Conditions of Sale are governed by Spanish law.

In case of conflict, the parties will submit to the courts and tribunals that correspond according to applicable regulations.

When the customer is a consumer, the competent courts and tribunals will be those determined by the current consumer and user regulations.
